Whether or not the child's mother or father was there isn't the point. Neither should take the law into their own hands against this creep. If they did, they would have drawn the wrath of justice even if we're sympathetic. Rather, it would be much more appropriate to have a Judge order him to be bound, placed against a stake in the middle of the town square and let the public pass by and take their own slaps at him That's called societal retribution!
